AMA Issue brief: Federal parity report once again shows payers’ failures

The DOL/HHS/IRS 2024 Report to Congress showed that health plans and issuers continue to fail to comply with the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA) and subsequent Congressional enhancements to MHPAEA. Failures ranged from improper denial of care for mental health and substance use disorders (MH/SUD), inadequate MH/SUD networks, and failure to reimburse MH/SUD providers on par with medical/surgical providers. AMA summary of MHPAEA final rule

On September 9, 2024, the U.S. Departments of Labor, Health and Human Services, and Treasury released a final rule implementing the Mental Health Parity and Addiction Equity Act (MHPAEA). The 513-page rule includes numerous provisions strongly supported by the AMA and represents an opportunity for state legislatures and departments of insurance to strengthen their own parity laws.
